First, the bad news: Ordering cannabis seeds online is currently under attack by the U.S. government. The good news: the proposed seed ban has been delayed a month until December 11, 2026, and legislation to stop the redefinition of cannabis seeds has been introduced. Are things looking up?

The U.S. Cannabis Seed Crackdown No One Saw Coming
Last year on November 12, 2025, anti-cannabis regulation was snuck in at the last minute as part of a bill to re-open the U.S. federal government after an extended shutdown. The new legislation redefined hemp to exclude viable cannabis seeds from any plant with over 0.3% THC.
Since the passage of the 2018 Agriculture Improvement Act, cannabis seeds (which themselves do not contain over 0.3% THC) have legally been considered hemp seeds. At that time, an explosion of cannabis seeds became widely available by mail within the United States. The DEA on January 6, 2022 explicitly re-iterated that a cannabis seed (containing no more than 0.3% delta-9 THC by dry weight) “meets the definition of ‘hemp’ and thus is not controlled under the [Controlled Substances Act].”
Since 2018, U.S. law defined most cannabis seeds as hemp seeds (which can be mailed).
The new law seeks to change the definition of hemp…
- Seeds from high-THC plants would no longer be considered hemp seeds – The enacted legal definition of hemp would exclude viable seeds from a plant that exceeds 0.3% THC, even if the seeds themselves do not contain THC. As written, that could effectively make most cannabis seeds illegal.
- Most “intoxicating” hemp would no longer be considered hemp – Hemp-derived products (including delta-8, delta-10, THC-A, and concentrated hemp flowers) are subject to new definitions and thresholds in this law. This makes access to seeds more important than ever.
- Set to start December 11, 2026 – The hemp and cannabis definition changes in H.R. 5371 have been postponed from November to December 11. Learn more.
There are positive signs that the seed part of the law might be changed for the better before going into effect. If so, that’s a great thing.
But here’s what’s important: None of this stops home growers who stay informed.
U.S. laws change, but growers won’t. Seeds have been contraband before, and that’s never stopped the cannabis home grow movement.

Straight talk here for a second. Cannabis seeds were easy to get long before the current “loophole” made them “legal” in 2018. Genetics aren’t going anywhere.

What you can do right now
- Start a personal stash of seeds from various genetics. See recommended seed banks.
- Store seeds well. Practice good long-term seed storage (cool, dark, dry)
- Share genetics with other home growers in need, when it’s safe.
- Teach yourself how to grow with our free tutorials so you get more from each seed.
- U.S. Voter? We need you. Cannabis is not inherently “left-wing” or “right-wing”. There are supporters and detractors on both sides. We need to stick together as growers to vote in pro-cannabis politicians, and vote out anti-cannabis politicians, regardless of party. How to help save cannabis seeds if you’re a U.S. citizen

Contact your US Senators and Representatives today. Stay professional. Stay away from the cannabis debate. The legal experts in the cannabis seed industry believe our best case is to treat this as purely an agricultural issue. Ask your representative to support the fix in H.R. 9830 before December 11, 2026.
Example points:
- “Please support the fix in H.R. 9830 before December 11, 2026.”
- Hemp seeds are non-intoxicating.
- The law should judge hemp seeds based on the THC contained in them, as it has since 2018.
- This new law would hurt farmers and other parts of the agricultural industry by adding impossible-to-follow regulations and bureaucracy.
- “This is a seed and agriculture issue that has nothing to do with legalizing cannabis.”
A refrigerator crisper drawer is an excellent place to store seeds.
